How Removal Proceedings Work

Removal proceedings begin when the government issues a Notice to Appear (NTA), a charging document that sets out the legal basis for why you should be removed from the United States. Once the NTA is filed with the immigration court, you become a respondent in a proceeding before an immigration judge within the EOIR system.

For non-detained individuals in Arkansas, those hearings are typically held at the Memphis Immigration Court. The process moves through an initial master calendar hearing, where charges are addressed and relief applications are identified, and then to merits hearings where the case is argued before the judge. Missing a scheduled hearing date can result in an in absentia removal order, meaning the judge issues an order of removal without you present.

Common grounds for removal include unlawful entry, visa overstay, fraud in obtaining immigration benefits, and certain criminal convictions. Detained cases follow a faster timeline and may be heard at a different venue depending on where the individual is held.

Forms of Relief That May Be Available

Removal isn’t always the final outcome. Depending on your circumstances, there may be legal pathways to remain in the United States. We evaluate options at the start of representation so nothing is overlooked.

Cancellation of removal has different eligibility requirements depending on your immigration status. For non-lawful permanent residents, eligibility generally requires ten years of continuous physical presence, good moral character, and a showing that removal would cause exceptional and extremely unusual hardship to a qualifying U.S. citizen or LPR spouse, parent, or child. Lawful permanent residents face a separate set of residency and criminal history requirements.
Asylum may be pursued if you face persecution in your home country based on race, religion, nationality, political opinion, or membership in a particular social group
Adjustment of status to lawful permanent resident may be available if you have a qualifying family or employment petition pending
Voluntary departure allows you to leave the country on your own terms rather than under a formal removal order, which may reduce certain future bars to reentry depending on your individual circumstances
Appeals to the Board of Immigration Appeals (BIA) are available after an adverse ruling and may allow you to remain in the U.S. while the appeal is pending
Waivers of inadmissibility may be available to overcome certain grounds of removal or ineligibility depending on your individual facts

A criminal conviction can trigger removal proceedings even for someone who has lived in the United States for decades as a lawful permanent resident. Under the Immigration and Nationality Act, certain offenses are classified as aggravated felonies or crimes involving moral turpitude, categories that can make a noncitizen deportable or inadmissible.
