When Probate Is Required in Arkansas

Not every estate goes through a full probate proceeding. In Arkansas, if an estate’s non-homestead assets are valued under $100,000, a simplified small estate affidavit process may be available. Whether or not a valid will exists, this can resolve the matter without full court administration. Once the estate exceeds $100,000, formal probate through the Benton County Circuit Court is required regardless of whether a will exists.

When someone dies without a will, they’re said to have died intestate. The Benton County Circuit Court then distributes assets according to Arkansas intestate succession law, and the deceased person’s wishes carry no legal weight without a valid will. What Formal Administration Involves

Formal estate administration follows a defined sequence. A petition is filed with the Benton County Circuit Court, which then issues Letters Testamentary, the legal authority allowing a personal representative to act on behalf of the estate. From there, the personal representative inventories and appraises assets, notifies creditors, pays valid debts and applicable taxes, and distributes remaining assets to beneficiaries.
