Grounds for an Uncontested Divorce in Arkansas

Arkansas law requires proof of a specific legal “ground” for divorce even in uncontested cases (Ark. Code Ann. § 9-12-301). You can’t simply tell the court you no longer wish to be married.

General Indignities (The Most Common Ground)

Because Arkansas doesn’t offer a simple “irreconcilable differences” option, General Indignities is the ground most couples use in uncontested divorces.

How it works: One spouse alleges that the other’s conduct made married life intolerable. In an uncontested setting, the parties agree not to contest the allegation. The plaintiff testifies briefly about the marriage breaking down, and the case proceeds without a contested evidentiary hearing.

The benefit: It lets you bypass the long waiting period required for a no-fault divorce.

18-Month Separation (The No-Fault Ground)

If you don’t want to allege any wrongdoing, you can proceed under the 18-month separation ground instead.

How it works: You must prove that you lived “separate and apart” without cohabitation for 18 continuous months before filing (Ark. Code Ann. § 9-12-301(b)). Arkansas has one of the longest no-fault separation requirements in the country. In an uncontested case, both parties confirm the timeline is accurate. Even one night of cohabitation during those 18 months resets the clock to zero.

The Corroboration Requirement in Uncontested Cases

Under Ark. Code Ann. § 9-12-306, true uncontested divorces are exempt from the corroboration requirement for grounds. A third-party witness is not required to testify to fault grounds when the divorce is fully uncontested.

Residency is a separate matter. Arkansas requires corroboration of the residency requirement: at least 60 days of Arkansas residency to file, and three full months before the final decree can be entered. That corroboration typically takes the form of a witness deposition or affidavit. Some judges may finalize an uncontested divorce entirely on affidavit, without a live courtroom hearing. Practice varies by judge, and knowing what a specific judge requires can reduce one of the most common sources of last-minute delay.
