How Long Does an Uncontested Divorce Take in Arkansas?

Arkansas imposes a mandatory 30-day waiting period between the date the complaint is filed and the date a decree can be entered, with no exceptions even in fully agreed cases. At least one spouse must also have maintained three full months of Arkansas residency before the final decree is entered (Ark. Code Ann. § 9-12-307).

When residency is already established and both spouses cooperate, a realistic uncontested divorce timeline runs approximately 45 to 90 days from filing to final decree. Contested cases, by comparison, routinely take 12 to 18 months or longer. Several factors determine where your case falls in that range.

Variables that influence the timeline include:

  • Whether all issues are resolved before filing
  • How quickly required paperwork is completed and returned
  • Court scheduling and processing times at the Benton County Circuit Court
  • Whether children are involved and whether any required parent education program has been completed
